Terms of Service
Agreement to terms
By creating an OakData account or otherwise using the OakData platform, you agree to these Terms of Service and all applicable laws and regulations. If you don't agree, please don't use the service.
Service description
OakData is a web analytics and session replay platform. The service lets you:
- Capture pageviews and custom events from websites you own through our JavaScript tracker or server-side API
- Explore the data through real-time dashboards, visitor profiles and journeys, and conversion funnels
- Record and replay user sessions on those websites, with configurable masking and exclusion
- Export data and integrate with downstream tools via our API and (on higher plans) warehouse sync
Account terms and responsibilities
When using the service you agree to:
- Provide accurate account information and keep credentials secure
- Only install the tracker on websites and apps you own or have explicit authorisation to instrument
- Comply with applicable privacy laws (GDPR, UK GDPR, CCPA, ePrivacy, etc.), including providing visitors with the notices and choices those laws require
- Configure session replay masking and block-selectors so that sensitive personal data (passwords, payment details, health information, etc.) is not recorded
- Not use OakData to track individuals without a lawful basis, including building profiles for purposes unrelated to your own product
- Not attempt to circumvent plan limits, reverse-engineer the platform, or interfere with other customers
- Be responsible for any content or instructions submitted by users you add to your account
Free trial
Paid plans start with a 7-day free trial. We collect your payment method at checkout but do not charge you until the trial ends. You can cancel before the trial ends from your account dashboard at no cost. Only one free trial is available per customer.
Usage limits and fair use
Each subscription plan includes specific limits:
- Events: the maximum number of analytics events ingested per billing period across all of your websites
- Websites: the maximum number of websites/domains you can add to your account
- Data retention: how long event and replay data is retained before being purged
Current limits are displayed on the pricing page and in your account. We allow a 10% grace buffer on event counts; sustained overages may result in throttling or service restrictions. You can upgrade at any time to raise limits.
Payment terms
- Subscription fees are billed in advance for each period (monthly or annually)
- Fees are non-refundable except where required by law
- We may change pricing with at least 30 days' notice for the next renewal
- Failed payments may suspend or terminate the subscription after a reasonable grace period
- You are responsible for any applicable taxes
- Annual plans receive the discount published on the pricing page at the time of purchase
Data ownership
- Your visitor data: you retain ownership of all analytics events and replay recordings ingested into your account. You grant OakData a non-exclusive licence to host, process, and display that data solely to provide the service to you.
- Our platform: OakData owns the platform, dashboards, tracker code, and underlying systems, including any improvements derived from aggregated, anonymised operational telemetry.
- Export and deletion: you can export your data via the API at any time during the subscription, and request deletion at any time.
Acceptable use
You must not use OakData to track minors in violation of applicable law, to capture sensitive categories of personal data without a lawful basis, to install the tracker on websites without authorisation, or to attempt to stress, overload, or probe our infrastructure beyond your plan limits. We may suspend or terminate accounts that violate these rules.
Service availability and support
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and incidents may temporarily affect ingest or dashboard access.
Support is provided by email for all paid plans, with priority and dedicated channels on higher tiers as described on the pricing page.
Cancellation and termination
- You can cancel at any time from your account; cancellation takes effect at the end of the current billing period
- Cancelling during the free trial stops billing before the first charge
- We may suspend or terminate accounts that violate these terms, with notice where reasonably possible
- Upon termination, access to the dashboard ends and your data is purged within 30 days, except where retention is required by law
- No refunds are provided for partial periods unless required by law
Disclaimer and limitation of liability
The service is provided "as is", without warranties of any kind. To the maximum extent permitted by law, OakData is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising out of your use of the service. Our aggregate liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
Changes to terms
We may update these Terms from time to time. We will notify customers of material changes by email or through the dashboard, and update the date at the top of this page. Continued use of the service after the changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of Portugal, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of Portugal.
